1. Nature of Our Business — Important Disclosure
Fusion Link ("we", "us", "the Company") operates as an authorized reseller and marketing/service partner for broadband internet plans provided by [Licensed ISP Legal Name] ("the ISP", "the Licensed Partner"), which holds a valid Internet Service Provider (ISP) license issued by the Department of Telecommunications (DoT), Government of India.
We expressly clarify:
- We are not an Internet Service Provider (ISP) and do not hold, nor are we required to hold, an ISP license.
- We are not a registered Public Data Office (PDO) under the PM-WANI framework.
- The actual internet bandwidth, network infrastructure, last-mile connectivity, and telecom licensing compliance are provided and owned solely by the ISP.
- Our role is limited to: customer acquisition, plan sales, order facilitation, coordination for installation/activation, local billing/collection (where applicable), and first-level customer support, acting on behalf of and under authorization from the ISP.
- We also operate a network of Local Cable Operator (LCO) partners who assist us in sales, installation coordination and local support in their areas, under the same reseller framework.
By using our website, WhatsApp channel, or booking a connection through us, you acknowledge and accept this reseller relationship.
2. Services We Provide
- Displaying and explaining broadband, IPTV, OTT and Android TV Box plans available from the ISP in our serviceable areas.
- Assisting you in placing new connection requests, upgrades, or plan changes.
- Coordinating installation/activation timelines with the ISP's technical team or our local LCO partner.
- Acting as a first point of contact for billing queries, complaints, and support, escalated to the ISP where required.
We do not control network uptime, bandwidth provisioning, IP allocation, or core technical infrastructure — these are solely managed by the ISP.
3. Order, KYC & Activation
- Every new connection requires valid KYC (Proof of Identity + Proof of Address) as mandated by DoT rules for broadband/internet connections.
- Submission of KYC does not guarantee activation; final approval and activation are subject to the ISP's network feasibility and verification.
- Installation timelines shown on our site or communicated by our team are estimates and may vary due to technical feasibility, local infrastructure, or events beyond our control.
- Any installation charges, security deposits, or equipment (router/ONT/Android TV Box) charges will be clearly communicated before order confirmation.
4. Billing & Payment
- Billing cycles, tariffs and plan validity are set by the ISP; we display and, where authorized, collect payment on the ISP's behalf.
- We are not liable for billing disputes arising from ISP-side errors, but will assist in escalating and resolving them promptly.
- Late payment may result in temporary suspension of service as per the ISP's Fair Usage and Suspension Policy.
5. Refunds & Cancellation
Please see our full Refund & Cancellation Policy for details on timelines, eligibility and deductions.
6. Service Level, Outages & Liability
- Uptime, speed, and quality-of-service commitments are governed by the ISP's own service terms, not by us.
- We use reasonable efforts to log and follow up on complaints but do not guarantee resolution timelines for network-level issues, which are outside our control.
- We shall not be liable for loss, damage, or inconvenience caused by service outages, speed fluctuations, billing errors, or ISP-side licensing/regulatory issues.
- Our liability, if any, is limited to our role as facilitator/reseller and shall not exceed the fee or commission earned by us on the specific transaction in question.
7. Your Responsibilities
- Provide accurate KYC and address details.
- Use the internet connection lawfully; misuse may result in ISP-initiated suspension or legal action as per applicable law.
- Provide safe access to your premises for installation/repair visits.
- Report faults promptly through our support channels.
8. Grievance Redressal
- Level 1 (Us): Contact us via phone, email, or WhatsApp. We aim to acknowledge within 24 hours.
- Level 2 (ISP Escalation): If unresolved within a reasonable period, we escalate to the ISP's nodal officer / grievance cell.
- You also retain the right to approach the ISP directly, since it is the licensed provider of record, or TRAI's consumer grievance channels.
9. Termination
Either you or the ISP (through us) may terminate the connection with reasonable prior notice, subject to the ISP's terms. We reserve the right to stop facilitating service for anyone who violates these terms, is abusive toward our staff, or repeatedly defaults on payment.
10. Limitation of Our Role
Nothing in these Terms shall be construed as Fusion Link acting as a licensed telecom/internet service provider. All representations regarding network quality, speed, or regulatory compliance are the sole responsibility of [Licensed ISP Legal Name]. Any binding service agreement for the actual internet service is between you and the ISP, facilitated by us.
11. Governing Law & Jurisdiction
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts at [Your City].
